BILL NUMBER:S5231B
Title of bill
An act to amend the volunteer firefighters' benefit law and the volunteer ambulance workers' benefit law, in relation to permanent and temporary total disability benefits
Purpose
To increase awards under the Volunteer Firefighters' Benefit Law and the Volunteer Ambulance Workers' Benefit Law.
Summary of provisions
Section 1. Amends section 8 of the volunteer firefighters' benefit law to increase the weekly award for permanent total disability to $650 and increases the maximum limit of combined benefit plus wages or earnings to $975.
Section 2. Amends section 9 of the volunteer firefighters' benefit law to increase the weekly award for temporary total disability to $650 beginning January 1, 2015.
Section 3. Amends section 8 of the volunteer ambulance workers' benefit law to increase the weekly award for permanent total disability to $650 and increases the maximum limit of combined benefit plus wages or earnings to $975.
Section 4. Amends section 9 of the volunteer ambulance workers' benefit law to increase the weekly award for temporary total disability to $650 beginning January 1, 2015.
Section 5. Effective date.
Justification
Awards under the Volunteer Firefighters' Benefit Law (VFBL) and the Volunteer Ambulance Workers' Benefit Law (VABL) have not been increased since 1992. The Workers' Compensation Law, on the other hand, was amended in 2007 to provide that an employee who is totally disabled receives an award equal to 2/3 of the New York State average wage; an award that amounted to $775 in 2011. This bill seeks to narrow the gap between the Workers' Compensation Law and VFBL and VABL by increasing awards to volunteer firefighters and ambulance workers who are totally disabled from $400 to $650 per week.
