BILL NUMBER:S5232

Title of bill

An act to amend the education law, in relation to adulterated drugs

Purpose

To deter the adulterating, misbranding, and substituting of drugs by establishing civil monetary penalties for individuals that violate sections of the New York State Education Law relating to adulterated drugs.

Summary of provisions

Section 1 of the bill adds a new subdivision 3 to section 6815 of the education law to establish civil penalties for violating the provisions of such section.

Section 2 of the bill is the effective date.

Justification

The illegal importation of drugs, devices and cosmetics is one of global proportions. Most recently, the FDA, DOJ, DEA and Attorneys General have worked in concert to track down and stop this practice. New York State has always been a leader in promoting consumer protection and fighting fraud, and New York should continue this trend in the area of adulterated drugs. Presently, section 6815 of the education law sets forth when a drug or device is deemed to be adulterated. However, there exists no civil monetary penalty for violators of this section of law. By establishing appropriate civil penalties, this legislation aims to discourage, deter, and stop the illegal practices of dealing in adulterated or misbranded drugs and devices. Properly punishing those that violate laws on adulterated drugs in a manner that is not excessive will provide a level deterrence for the continuation of these dangerous practices and will make our communities safer and better protect our citizens.
