BILL NUMBER:S5467

Title of bill

An act to amend the criminal procedure law, in relation to the testing of certain criminal defendants for human immunodeficiency virus

Purpose or general idea of bill

Provides that a defendant who is charged with assault on a peace officer, police officer, fireman or emergency medical services professional or aggravated assault upon a police officer or a peace officer may be ordered to undergo HIV testing if the court determines there was a significant risk of transmission to the public protection official.

Summary of specific provisions

Section 1. Amends the Criminal Procedure Law by creating a new section 210.17 which provides that a defendant who is charged with assault on a peace officer, police officer, fireman or emergency medical services professional or aggravated assault upon a police officer or a peace officer may be ordered to undergo human immunodeficiency virus (HIV) related testing if the court determines there was a significant risk of transmission to the public protection official pursuant to the provisions set forth in section 178 of the Civil Service Law.

Section 2. Effective date.

Justification

According to data collected by the Federal Bureau of Investigation on Law Enforcement Officers Killed and Assaulted in 2011, the nationwide rate of officer assaults was 10.2 per 100 sworn officers. These assaults can lead to the potential transmission of bodily fluids between the suspect and the officer, and may put the officer at risk of contracting communicable diseases. This legislation provides that a defendant who is charged with assault on a peace officer, police officer, fireman or emergency medical services professional or aggravated assault upon a police officer or a peace officer may be ordered to undergo HIV related testing if the court determines there was a significant risk of transmission.
