BILL NUMBER:S5475

Title of bill

An act to amend the real property actions and proceedings law, in relation to requiring that certain public housing authorities establish an innocent tenant protection act applicable to tenants of public and federally assisted housing

Purpose or general idea of bill

The Innocent Tenants Protection Act, section 711-a, will amend the real property and proceedings law. This act authorizes public housing authority and owners of federally assisted housing to use leases providing protection rights for tenants who are either unaware of or attempted to put an end to any criminal or drug related activity committed by a family member on or off public assisted housing premises in the state of New York.

Summary of specific provisions

This bill will amend the real property and Proceedings law. This act authorizes public housing authority and owners of federally assisted housing to use leases providing protection rights for tenants who are either unaware of or attempted to put an end to any criminal or drug related activity committed by a family member on or off public assisted housing premises in the state of New York.

Justification

In United States Department of Housing and Urban Development v. Davis, the United States Supreme Court decided that anyone who leases Public or assisted housing is a potential target of "One-Strike" Evictions, whether or not the tenant is liable for the drug or criminal activity on the premises. The Innocent Tenants Protection Act will prevent honest, hardworking family members from being evicted, when family members (i.e. sons, daughters, or grandchildren) are involved in illegal acts.
