BILL NUMBER:S5528
Title of bill
An act to amend the private housing finance law, in relation to the administration of federal rental assistance programs by community development corporations
Purpose
Relates to the administration of federal rental assistance programs by community development corporations.
Summary of provisions
Section One amends section 254 of the private housing finance law by adding a new section which provides that any community development corporation administering a federal rental assistance program must file an annual statement verifying that all rental units under the program meet all applicable building codes, ordinances and regulations. Failure to comply with this section shall be grounds for the state to rescind such corporation's authority to administer the program unless the defect is repaired within thirty days. Due process protections are provided for the community development corporation, which require them to be given written notice of any violation and that their failure to bring the unit into compliance within thirty days may result in their authority to administer the program being rescinded.
Justification
The New York State Homes and Community Renewal Section 8 Housing Choice Voucher (HCV) Program provides rental assistance and home ownership options to eligible low-income households, senior citizens, disabled persons on fixed incomes, displaced families, and homeless individuals with disabilities across the State. The regulations for the HVC Program are set by the U.S. Department of Housing and Urban Development (HUD) and eligibility requirements must meet federal Housing Quality Standards. Housing Choice Vouchers are federally funded by HUD and are administered locally by public housing agencies.
Through the HCV Program, decent, safe and sanitary housing is made available to eligible individuals so they have an opportunity to make a home, raise a family and work toward making a positive contribution to society. If an administering agency is not consistent in strictly adhering to the program parameters or continues to fall short on meeting even the minimum compliance standards, this program can very quickly turn into unwelcome blight that imposes significant quality of life issues and imperils surrounding neighborhoods.
It is imperative that this program always be administered and implemented at the highest level. Proper code enforcement is of utmost importance to not only to protect the health, safety and well-being of program participants and neighboring residents, but also to assure the proper implementation of this federal program in communities throughout the State.
Enactment of this legislation is necessary to ensure that rental units under the HCV Program are, in fact, current in meeting all applicable building codes, ordinances and regulations of the municipality where such unit is located.
