BILL NUMBER:S5609
Title of bill
An act to amend the town law, in relation to the date of public hearings by improvement district commissioners in the year 2013
Purpose or general idea of bill
To authorize improvement district commissioners to hold a public hearing regarding their annual budgets, a week later than typically required by law in the year 2013, to accommodate the observance of Rosh Hashanah.
Summary of specific provisions
Section one amends section 215 of the town law to allow for the date for a required public budget hearing to be held on the second Thursday in September in 2013.
Section two sets the effective date.
Justification
The Legislature has traditionally allowed exceptions to codified date requirements for certain proceedings if such dates conflict with days of State and National importance. Most recently, the statewide primary elections in 2012 were moved from Tuesday to Thursday in observance of the anniversary of September 11, 2001.
The High Holy Day of Rosh Hashanah, a date of extreme religious significance to members of the Jewish faith, is observed on Thursday, September 5, 2013; the first Thursday after the first Tuesday in September, the date that improvement districts are required by Town Law section 215 to hold their annual public budget hearings. This legislation will delay that public hearing requirement by one week to accommodate the observance of the High Holy Day.
