BILL NUMBER:S5701
Title of bill
An act to amend the criminal procedure law, in relation to security services in the courts of the county of Steuben
Purpose or general idea of bill
To authorize the inclusion of Steuben County Sheriff deputies serving as court security deputies as peace officers.
Summary of specific provisions
Section 1. Subdivision 21 of section 2.10 of the criminal procedure law is amended by adding a new paragraph g to include a deputy sheriff who is employed by the sheriffs department of Steuben County to perform the delivery of security services to the courts, as peace officers.
Justification
The Steuben County Sheriff's Court Security Division has a staff of about 20 Officers that provides security for Courts and Judges per contract with the Office of Court Administration (OCA). These Officers, some of them armed are not listed in the Criminal Procedure Law as Peace Officers. Due to this, they don't have the authority to legally and effectively provide the necessary security for the Court System and all those citizens that have contact with the courts.
This legislation does not authorize those becoming peace officers thereunder to carry, possess, repair or dispose of a firearm unless the appropriate license therefore has been issued pursuant to section 400.00 of the penal law" will not in any way limit the Steuben County Sheriffs present authority to arm these officers pursuant to County Law Section 650-652 and Judiciary Law Section 400.
This legislation has been requested by the Steuben County Sheriff's Office and is necessary to ensure Steuben County Sheriff Court Security Officers can legally and effectively provide the security for the court system that is needed to ensure courts safety for all those involved.
