BILL NUMBER:S5718A
Title of bill
An act to amend the tax law, in relation to authorizing the county of Livingston to impose an additional mortgage recording tax and authorizing such county to expend such mortgage recording tax on necessary county services; and providing for the repeal of such provisions upon expiration thereof
Purpose
To authorize Livingston County to impose an additional mortgage recording tax of twenty-five cents per one hundred dollars of mortgage debt.
Summary of provisions
Section 1 amends the tax law by adding a new section 253-y which authorizes the Livingston County Board of Supervisors to amend local laws to impose a twenty-five cent mortgage recording tax per each one hundred dollars of mortgage debt.
This section also establishes how this tax shall be administered and collected.
Section 2 authorizes the Livingston County Treasurer to deposit proceeds into the County's General Fund.
Section 3 provides that this act shall take effect January 1, 2015 and shall expire and be deemed repealed December 31, 2016.
Justification
The Livingston County Board of Supervisors has requested state authorization to impose an additional .25% mortgage recording tax.
In recent years, the State Commission on Corrections mandated the expansion of the Livingston County Jail, a project that has cost county taxpayers $28.7 million plus interest. This home rule authorization is necessary to address the debt service related to this capital project.
