BILL NUMBER:S5731B
Title of bill
An act to amend the public health law, in relation to unlawful interference with research laboratory operations
Purpose
To deny access to certain records concerning biomedical research if it would endanger the life or safety of any person, or the safety and security of a biomedical research laboratory.
Summary of provisions
Section 1: Section one amends the public health law by adding a new section 506 to deny access to records or portions concerning biomedical research if such disclosure could endanger the life or safety of any person or would be reasonably likely to endanger the security of such biomedical research laboratory.
Section 2: Section two outlines an immediate effective date.
Justification
New York is home to a number of world class biomedical research institutions. The work being done in state is often at the forefront of biomedical science and is quite literally saving lives. Unfortunately, researchers across the country have found themselves the target of individuals and groups who are opposed to the work they are doing for any number of reasons Researchers have received threatening letters, have been the victims of vandalism, cyber harassment and, in the most egregious circumstances, they and their families have been the victims of violence. This legislation would deny access to records concerning biomedical research or biomedical teaching if such disclosure could endanger the life or safety of any person or would be reasonably likely to endanger the security of such biomedical research laboratory. A number of states, most notably California, in the wake of a number of violent incidents, have taken similar action in order to support and protect their researchers. New York, as a leader in biomedical research, certainly should be pro-active on this important issue.
