BILL NUMBER:S5752
Title of bill
An act to amend the alcoholic beverage control law, in relation to notification of arrests and convictions
Summary of specific provisions
Section 1. Subdivision 2 of section 106-a of the alcoholic beverage control law is renumbered subdivision 3 and a new subdivision 2 is added to read as follows:
2. The authority shall plan and coordinate with the arresting agency that is located in a city with a population of one million or more on a strategic plan to effectuate such transfer of information regarding the notification of arrests and convictions related to an activity or crime that has taken place on a licensed premise.
The authority and the arresting agency shall seek input from the community regarding other relevant information that should be received by the authority from the arresting agency Such plan shall be posted on the agency's website by January first, two thousand fourteen and shall be annually updated thereafter.
Section 2 This act shall take effect immediately.
Justification
There is a gap in the information shared between the State Liquor Authority and policing jurisdictions when it comes to crimes committed at location of SLA license holder.
There is also a gap in the information gathered and solicited that is important to help the SLA and police monitor the illegal activity of and at premises of licensee.
This legislation allows for both community input into relevant data that should be transmitted and shared with the SLA and allows for the policing jurisdiction to share its policing data with SLA on related matter.
Both these additional information sharing components of this legislation will improve compliance by and regulation of the SLA licensee.
