BILL NUMBER:S5889
Title of bill
An act to amend the executive law, in relation to making certain technical amendments
Purpose
The purpose of this legislation is to make certain amendments to existing law to further the goals of START-UP NY and to stress the need for regulatory relief for businesses in the State. These amendments do not change the charge or procedures of the mandate relief council; they merely emphasize the need for the council to not only focus on mandate relief, but to also focus on regulatory relief.
Summary of provisions
Section one amends Executive Law § 666, subdivision one, to change the name of the "mandate relief council" to the "mandate and regulatory relief council" to emphasize the need for regulatory relief.
Section two adds the words "or business" to subdivision two to again emphasize the need for review of regulations that may be over-burdensome on businesses.
Section three adds a new subsection five to Executive Law § 666 giving businesses the ability to request the review of specific mandates or regulations by the mandate and regulatory relief council. Businesses will be limited to three requests per calendar year and the procedural rules of the council in reviewing requests coming from business will be the same.
Justification
New York State is generally viewed as having a bad business climate, in large part to the unduly burdensome and costly regulations that businesses have to deal with. These amendments are designed to emphasize the need to review these business regulations to determine if they are necessary.
