BILL NUMBER:S6118

Title of bill

An act to amend the labor law, the tax law and the social services law, in relation to jury pools for federal district courts

Purpose or general idea of bill

To broaden the diversity of jury pools for federal district courts.

Summary of specific provisions

Section one would allow any court clerk or jury commission of a United States District Court to access lists of persons receiving unemployment insurance benefits.

Section two would allow any court clerk or jury commission of a United States District Court to receive a mailing list of New York State tax filers.

Section three would allow any court clerk or jury commission of a United States District Court to obtain the names and addresses of persons applying for or receiving aid to dependent children, Medicaid, or home relief.

Section four provides the effective date.

Justification

This legislation would allow the federal courts in New York State to have the same access to source lists to populate jury pools as those accessible by New York State Courts. The Courts in New York State use five source lists from which to draw prospective jurors: (1) registered voters, (2) licensed drivers, (3) New York State Tax filers, (4) New York State Unemployment Insurance recipients, and (5) New York State recipients of family assistance.

The federal courts currently use the first two source lists, i.e., registered voters and licensed drivers, however, federal courts are prohibited under State law from receiving the other three source lists. Implementation of the changes proposed in this legislation will enable the federal courts in New York to summon prospective jurors that better represent the diversity of our community.
