BILL NUMBER:S6212

Title of bill

An act to amend the village law, in relation to the authority of the state fire administrator to grant a waiver for the election of non-resident members in the fire company

Purpose or general idea of bill

To allow a village fire district or company to apply to the State Fire Administrator for a waiver allowing them to have more than 45 percent of members living outside of the Village.

Summary of specific provisions

Section 1 would allow a village fire district or company to apply to the State Fire Administrator for a waiver allowing them to have more than 45 percent of members living outside of the Village. Further allows for a neighboring fire district to challenge this waiver within 60 days. If an objection is made, State Fire would make a determination based on the application and the waiver.

Section 2 is the effective date.

Justification:

Current law allows for Towns to apply for a waiver to the local membership provisions. These waivers would allow villages to ensure that they have enough members to provide. adequate fire coverage for the municipality. Sometimes individuals reside outside the boundary of a particular fire company or district and would like to be involved with that particular company, by capping the percent of members that are allowed outside its boundaries, a village fire district would be unable to have that individual as a member should that bring them above forty five percent non residents.

This law is already in place for Towns and it is only appropriate that the same exemption be provided for Villages.
