BILL NUMBER:S6788

Title of bill

An act to amend the mental hygiene law, in relation to the community mental health support and workforce reinvestment program

Purpose

The bill will require the calculation of savings from in-pa- tient state operated psychiatric hospital bed closures, which determines the funding for the Community Mental Health Support and Workforce Rein- vestment Program (Reinvestment), to be based upon the actual costs of the beds. A schedule of rates for inpatient services is already estab- lished under section 43.01 of the Mental Hygiene Law.

Summary of provisions

Section 1 states the calculation of savings for purposes of Reinvestment will be calculated consistent with the provisions of Section 43.01 of the MHL, reduced by the vacancy rate of the state operated in-patient hospital bed census for the most recent year available.

Section 2 is the effective date.

Justification

Since the inception of the Community Mental Health Rein- vestment Act in 1993, the calculations used to determine the value of a state operated in-patient psychiatric hospital bed result in an amount with no substantiating documentation. For nearly 20 years, Reinvestment has been the only potential source of funding for new and innovative community-based programming. Reinvestment has not been fully funded in most of those years, and billions of dollars for community mental health services have been lost.

For the first time in many years, this year's proposed budget estimates savings and proposes funds for Reinvestment. The 2014-15 budget estimate for the savings from a bed closure in the proposed budget is $110,000. However, according to recent billings from the State Office of Mental Health, the daily rate under MHL § 43.01 was $1118.00 per day. On an annualized basis, that is $408,000 per year. Recognizing that each bed in the census is not fully occupied each day, the bill reduces the 43.01 amount by a factor of the average vacancy rate for the most recent year available.
