BILL NUMBER:S6943

Title of bill

An act to amend the education law, in relation to the definition of eligible children for the purposes of universal prekindergarten programs

Purpose

Allows a school district to approve a resolution to increase the age eligibility for children to enroll in universal pre-kindergarten programs.

Summary of provisions

Paragraph c of subdivision 1 of Section 3602-e of the Education Law is amended to allow a school district to adopt a resolution expanding the definition of "eligible children" with respect to universal pre-kindergarten programs to include resident children who are five years of age.

Justification

Under current law, children who are eligible for a school district's universal pre-kindergarten program have to be resident children who are four years of age on or before December lst of the year in which they are enrolled or who will otherwise be first eligible to enter public school kindergarten commencing with the following school year. A public school may not offer their pre-kindergarten program to children who are of age to attend kindergarten. In some cases, however, children who turn five during the fall months may not be emotionally, physically, socially, psychologically or developmentally ready for kindergarten. The early childhood curriculum provided by universal pre-kindergarten programs would greatly benefit these children and better prepare them for their subsequent kindergarten experience. This legislation would allow school districts to adopt a resolution to make resident children who are five years of age eligible for the district's universal pre-kindergarten program.
