BILL NUMBER:S6951

Title of bill

An act to amend the public health law, in relation to establishing certain substances as banned substances

Purpose

Add two substances to schedule I of section 3306 of the Public Health Law.

Summary of provisions

Section 1 adds 4 substances to schedule I of section 3306 of the public health law. The first substance added is N-(2-methoxybenzyl)-2, 5-dimethoxy-4-iodoplaenethylamine, its optical isomers, salts, and salts of isomers. This is also known as 251-NBOME, 2C-1-NBOME, and Cimbi5.

The second substance is 2,5-dimethoxy-4-iodophenethylamine, its optical isomers, salts and salts of isomers.

The third is 2-(4-chloro-2,5-dimethoxyphenyl)-N-(2-methoxybenzypethananaine, its optical, positional, and geometric isomers, salts and salts of isomers. This is also known as 25 CNBOMe, 2C-C-NBOMe, 25C, and Cimbi-82.

The fourth is 2-(4-bromo-2,5-dimethoxyphenyI)-N-(2-methoxybenzyl)ethanamine, its optical, positional, . and geometric isomers, salts and salts of isomers. This is also known as 25 BNBOMe, 2C-B-NBOMe, and Cimbi-26.

Section 2 provides the effective date.

Justification

In recent years, the use of synthetic drugs has become increasingly widespread. These drugs have been created by manufacturers as an alternative to already-illegal drugs. Four of these substances, 251- NBOMe, 2C-I, 2CNBOMe, and 25 BNBOMe are known as "N-Bomb" or "Smiles."

N-Bomb is meant to mimic the effects of LSD as a hallucinogen. However, these drugs have harrowing effects. In many cases, individuals have overdosed as a result of N-Bomb. Because these drugs are chemically made, and as such its potency varies widely, it is difficult to predict how a particular person may react to the substances. Some effects include seizures, psychotic episodes, loss of consciousness, and bleeding from the brain. The drug is produced either as a liquid or powder, or as tabs on blotter paper.

This legislation would make N-Bomb illegal in order to prevent the harmful results of these drugs from reaching New York. Similar legislation was recently signed into law in Arizona. The DEA has also temporarily scheduled these substances as of October 10, 2013.
