BILL NUMBER:S6969
Title of bill
An act to amend the public authorities law, in relation to the membership of the New York state energy research and development authority
Purpose of the Bill:
The bill would substitute the President and Chief Executive Officer (CEO) of the Power Authority of the State of New York (NYPA) for the Chair of NYPA as an ex-officio member of the New York State Energy Research and Development Authority (NYSERDA).
Summary of Provisions:
Section 1 of the bill would amend Public Authorities Law (PAL) 1852(2) to substitute the President and CEO of NYPA for the Chair of NYPA as an ex-officio member of NYSERDA. Section 1 also makes a minor technical correction to PAL § 1852(2).
Section 2 of the bill provides for an immediate effective date.
Existing Law:
Currently, PAL § 1852(2) provides that the Chair of NYPA is an ex-officio member of NYSERDA.
Prior Legislative History:
This is a new bill.
Statement in Support:
When PAL § 1852(2) was enacted, the Chair of NYPA was permitted under PAL § 1004 to be the CEO of NYPA. Section 7 of the Public Authorities Accountability Act of 2005 (Chapter 766 of the Laws of 2005) amended PAL § 1004 to preclude the designation of the Chair of NYPA as CEO. Accordingly, the President of NYPA is now designated as the CEO, and it is appropriate that the President and CEO of NYPA rather than the Chair of NYPA be an ex-officio member of NYSERDA.
Budget Implications:
None.
Local Impact:
The bill would have no impact on local governments.
Effective Date:
The bill would take effect immediately.
