BILL NUMBER:S7324

Title of bill

An act to amend the state finance law and the public buildings law, in relation to the consolidation of statutory procurement and consulting reports; and to repeal certain provisions of the state finance law relating to reporting

Purpose

The purpose of this legislation is to consolidate certain statutory procurement and consulting reports.

Summary of provisions

Section 1 deletes subdivision 17 of section 8 of the State Finance Law and replaces it with a new Subdivision 14 of Section 163 of the State Finance Law that governs the requirement for the Office of the State Comptroller to report annually on consulting contracts.

Section 2 deletes Subdivision 5 of Section 9 of the Public Buildings Law and replaces it with a new Subdivision 14 of Section 163 of the State Finance Law that governs the requirement to report annually on emergency construction contracts in an amount exceeding ten thousand dollars.

Section 3 repeals the current Subdivision 14 of Section 163 of the State Finance Law and adds a new Subdivision 14 relating to reporting by the State Comptroller. Section 3 also adds a new Subdivision 15 to Section 163 of the State Finance Law relating to reporting by state agencies.

Subdivision 14 requires the State Comptroller, within his or her discretion, to submit a report to the state procurement council, the governor, the Commissioner of the Office of General Services, the Director of the Budget, and the legislative fiscal committees containing data related to state agency contracts and provides that such report shall be made annually, on a fiscal year basis, by the first of July of the next succeeding year.

Subdivision 15 requires state agencies to report annually, on a fiscal year basis, by July first of the ensuing year to the State Procurement Council, the Governor, the legislative fiscal committees and the State Comptroller the total number and total dollar value of single source contracts awarded by the agency during the fiscal year, and the percentage such contracts represent of the agency's total number and total dollar value of contract awards during the reporting period.

Prior legislative history

New bill.

Justification

Currently, the Office of the State Comptroller is statutorily required to produce three major procurement related reports each year. These entail 12 separate reports to make available the specified information. In addition, the reports have various reporting periods and due dates (10 reports designed to meet the requirements of the Procurement Stewardship Act, one Emergency Contract Report, and one Consultant Contract Report). These reports are fragmented and difficult to analyze.

This proposal consolidates these reports into 3 newly defined reports (all active state contracts, contracts approved by the Office of the

State Comptroller and consultant contracts) to be prepared on a fiscal year basis. The proposal standardizes the reporting periods, and due dates and data fields included in each report. Additionally, the proposal authorizes disseminating the results in an electronic format thereby facilitating access to and transparency of the data contained in such reports.

This proposal does not reduce reporting requirements under current law.

Fiscal implications for state

This bill has no significant State fiscal impact.
