BILL NUMBER:S7370

Title of bill

An act to amend the election law, in relation to lever voting machines

Purpose

To ensure the security of lever voting machines used in village elections after such elections.

Summary of provisions

§ 1. The election law is amended by adding a new subdivision 2 to section 15-114 and existing subdivision 2 is renumbered as subdivision 3. This new section states that lever voting machines used in village elections shall remain locked against voting for a period of 30 days or until 15 days before the next election, if such machines are needed for use at the next election. It also specifies the conditions under which the machines may be unlocked.

§ 3. This act shall take effect immediately and be deemed repealed on December 31, 2014.

Justification

Bill A.7453/S.5385 (passed Senate June 14, 2011) removed language from the election law relating to the post-election security and disclosure of the contents of lever voting machines and updated the election law to provide for the security and storage of electronic memory devices as used by the new voting system. However, some villages throughout New York State may, until December 31, 2014, use lever voting machines for their local elections. This bill inserts the lever-machine security and disclosure measures taken out by S.5385 and applies them to villages using the lever machines. The provisions of this bill expire on December 31, 2014.
