BILL NUMBER:S7443

Title of bill

An act to amend the transportation law, in relation to recycled concrete aggregate

Purpose

Requires the commissioner of the department of transportation to conduct a study relating to the use and study of the use of recycled concrete aggregate

Summary of provisions

Section 1 amends the transportation law by adding a new section 17-c that outlines the use of recycled concrete aggregate in New York State.

Section 2 sets an effective date of one hundred eighty days after this bill shall become law.

Justification

Over the next several decades, New York State will need to reconstruct much of the infrastructure that is essential to the economic success of all of our communities. Worldwide, there is greater demand for basic building materials than ever before. This demand has increased the cost of many infrastructure projects due to regulations that often mandate the use of virgin materials that are often in short supply.

Recycled concrete aggregate needs to be thoroughly considered throughout New York State for infrastructure projects. Across the United States, 140 million tons of concrete are being recycled each year to help reduce the cost of many infrastructure projects. Fifteen states have built at least one trial project with RCA. The Federal Highway Administration conducted an in-depth review of RCA in 2003 and 2004 in Texas, Virginia, Michigan, Minnesota, and California that found many engineering, environmental, and economic benefits.

The American Society for Testing and Materials (ASTM) and the American Association of State Highway and Transportation Officials (AASHTO) accept recycled concrete as a source of aggregate into new concrete.

New York State has approximately 114,546 public road miles. The American Society of Civil Engineers estimates that 60% of New York's roads are in poor or mediocre condition. We have an urgent need for renewed investment in our infrastructure and recycled concrete aggregate has the potential to save money and provide better outcomes for taxpayers.
