BILL NUMBER:S7450
Title of bill
An act to amend the education law, in relation to establishing the "consumer construction protection act" and the licensing and certification of plumbing and mechanical trades
Purpose
Relates to establishing licensing and certification procedures for plumbing and mechanical trades occupations and establishing penalties and enforcement mechanisms for the violation of such requirements
Summary of provisions
Section 1 defines this act as the "consumer construction protection act"
Section 2 provides the legislative intent, which is to regulate, license, and certify the business of plumbing and relating mechanical trades, within the State of New York, in order to protect and promote the health, safety, and welfare of the residents of the State of New York.
Section 3 adds a new article 152 to the education law to regulate the business of plumbing and mechanical trades
Section 4 provides that this act shall take effect 90 days after it has become law.
Justification
Westchester is currently permitted by state law to maintain a countywide licensing system for plumbers, superseding any previous town or village licensing laws or ordinances. This bill would establish a statewide system for licensing plumbers and certain mechanical trades. Many municipalities have sought to have greater protections and a simplified approach to licensing plumbing and mechanical trades across the State of New York. The current system is an overly complicated licensing environment for many tradesmen. In many counties, plumbers and other tradesmen must obtain many different licenses if they intend to work and make a living providing their important skills and services. Another consequence of the current system is that plumbers who've had their license revoked can easily move to different localities and use the system to their advantage. The Consumer Construction Protect Act will improve the regulation of these trades for both the State of New York and our plumbers and tradesmen.
