BILL NUMBER:S7477

Title of bill

An act to amend the labor law, in relation to the impo- sition of mandatory gratuities

Purpose

The bill allows employers to charge mandatory service fees in relation to gratuities or tips intended for employees.

Summary of provisions

Section one amends section 196-D of the labor law to read as follows: An employer shall not be prohibited from adding a mandatory gratuity as long as (a) the charge is conspicuously disclosed to the customer before food or beverage is ordered and (b) no employer or his agent or an offi- cer or agent of any corporation shall retain any portion of such gratui- ty. The disclosure shall use ordinary language readily understood and shall appear in a type size similar to surrounding text.

Section two sets the enacting date.

Justification

Gratuities are an essential part of service worker sala- ries and in some cases workers rely on gratuities to make a decent living. Because gratuities fluctuate widely depending on who is doing the tipping, it is difficult for these employees to know how much they will make in any given week and effectively save money to plan for the future. Mandatory gratuities would provide a much-needed level of consistency for their wages.
