BILL NUMBER:S7483
Title of bill
An act to amend the executive law, in relation to requiring certain municipalities to display the prisoner of war and missing in action flag
Purpose
To require local governments to display the POW/MIA flag on certain days when the flag is provided to the municipality by a local veterans organization.
Summary of provisions
Subdivision 1 of Section 403-a of the Executive Law is amended to require municipalities (including New York City, but not the individual counties that comprise New York City) to display the POW/MIA flag at the building housing the local legislative body on Armed Forces Day, Memorial Day, Flag Day, Independence Day, National POW/MIA Recognition Day and Veterans Day when the municipality is provided a flag by a congressionally chartered veterans organization. Addi- tionally, upon request of the municipality, any fasteners or attachments necessary for the flag to visible to the public.
Justification
In 1971, the POW/MIA flag was designed to honor members of the armed forces imprisoned or missing during the Vietnam War. Today, the POW/MIA flag has become known as symbol of respect for any United States service member imprisoned or unaccounted for throughout history. This bill will require municipalities to raise this important and emblematic flag on Armed Forces Day, Memorial Day, Flag Day, Inde- pendence Day, National POW/MIA Recognition Day and Veterans Day when a congressionally chartered veterans organization donates the flag to a county, city, town, or village. If the municipality requires any fasten- ers or attachments to raise the flag, they must be provided by the veterans organization as well. Allowing local veterans organizations, like the American Legion or the Veterans of Foreign Wars to provide municipalities a POW/MIA flag to display, increases the level of aware- ness and appreciation for the individuals who fought for our country while providing no additional financial burden to communities.
