BILL NUMBER:S7514A

Title of bill

An act granting retroactive membership with tier II status in the New York state and local police and fire retirement system to Vincent Verret

Purpose

This home rule legislation would grant Vincent Verrett Tier II status in the New York State and Local Police and Fire Retirement System.

Summary of provisions

Section 1 of this bill notes that Vincent Verrett is a member of the New York State and Local Police and Fire Retirement System as of March of 2011. Prior to this, Mr. Verrett had been placed on a civil service list where he was reached while serving our country in the United States Marine Corps. Through no fault of his own he was unable to notify the Department of Civil Service that he was currently serving in the armed forces. Consistent with Section 243 of the Military Law, this legislation would deem Vincent Verrett a member of the retirement system as of the date an eligible person who was lower on the original list was appointed having Tier II status with every right, benefit and privilege which he would have had should he have been placed on the special eligible list.

Section 2 of this bill provides that past service costs shall be borne by the City of Schenectady.

Justification

Vincent Verrett had taken a civil service exam to serve the City of Schenectady as a firefighter. This list was certified on August 15, 2006, and in March of 2007 Mr. Verrett was canvassed for such position. However, prior to being canvassed, Mr. Verrett had enlisted in the United States Marine Corps to serve his country and did not learn that he was canvassed until he was honorably discharged from the US Marine Corps on January 7, 2011.

Section 243 of the Military Law provides that any person whose name on any eligible list shall, while in military duty, retain his or her rights on such list upon notification that such individual is serving on military duty. Unfortunately, prior to and while serving his country, Mr. Verrett was not aware of this notification requirement and, therefore, was not placed on a special eligible list. This bill would remedy this situation.
