BILL NUMBER:S7547A
Title of bill
An act authorizing the payment of ordinary disability retirement benefits by the New York state and local police and fire retirement system to the widow of Richard O'Brien
Purpose
This bill deems Richard O'Brien to have timely filed an application for the state police disability retirement benefit.
Summary of provisions
Section 1 states that Richard O'Brien shall be deemed to have timely filed an application for the state police disability retirement benefit on December 7, 2009 if, within one year of the effective date of this act, Stephanie O'Brien, the widow of Richard O'Brien, files a written request and a retirement option election form with the New York State Comptroller.
Section 2 states that any additional costs for this act shall be paid by the state of New York.
Section 3 states that this act shall take effect immediately.
Justification
Richard O'Brien was employed by the New York State Division of State Police as an investigator and was a member of the New York State and local police and fire retirement system at the time of his death on December 7, 2009. His application for state police disability retirement benefit was being processed, but not technically complete, at the time of his death. This bill deems Richard O'Brien to have timely filed that application, resulting in the payment of these benefits to Richard O'Brien's widow.
