BILL NUMBER:S7555

Title of bill

An act to amend the election law, in relation to absentee voting; and to repeal section 7-126 of the election law relating to the use of ballots

Purpose or general idea of bill

This bill offers technical amendments to make laws relating to ballots concurrent with current practices. It repeals a section of election law relating to the use of pasters (labels to replace someone on an already printed ballot). It also amends the laws relating to the use of absentee ballots so that the board of elections may receive applications for absentee ballots up to the day before an election.

Summary of specific provisions

§ 1. Section 7-126 of the election law addresses and requires the use of pasters or is repealed. With current voting machines, ballots are simply reprinted, making this section of law obsolete.

§ 2 Amends the rules regarding absentee ballot applications by allowing such applications, or a letter or other written instrument request such application, to be received by the board of elections up until the day before the election (not mailed to the board within 7 days of an election, as the language currently says).

§ 3 This act shall take effect immediately

Justification

By removing the requirement that ousters are used on ballots, it brings election law in line with current technology, as with modern voting machines, when there is a change on the ballot, the ballots arc simply reprinted.

By allowing the board of elections to receive applications, and requests for applications, for absentee ballots up the day before an election, and not necessarily by mail (in the case of a request for application), it will make it easier for voters to apply for absentee ballots.
