BILL NUMBER:S7596A

Title of bill

An act authorizing the county of Nassau to alienate certain parcels of land used as parkland

Purpose

This bill provides Nassau County with the authority to discontinue a parcel of parkland for the purpose of enabling the Roslyn Water District to construct, maintain and operate a water treatment facility.

Summary of provisions

Section 1 authorizes the county of Nassau, acting through its legislature, to discontinue a parcel of parkland for the purpose of enabling the Roslyn Water District to construct, maintain and operate a water treatment facility and appurtenances thereto.

Section 2 provides that this alienation of parkland shall only be effective upon the condition that the county of Nassau dedicate an amount equal to or greater than the fair market value of the parkland being discontinued for funding of capital improvements to existing park and recreational facilities.

Section 3 provides the metes and bounds description for the parcel of parkland that is being discontinued and alienated.

Section 4 requires that the discontinuance of parkland authorized by this act shall not occur until the county of Nassau has complied with any federal requirements pertaining to the alienation or conversion of parklands.

Section 5 provides that when the lands cease to be used for the purposes described in section one of this act, those lands shall be restored for park purposes with the cost of restoration being borne by the Roslyn Water District.

Section 6 establishes the effective date.

Justification

In order to meet demands for water, the Roslyn Water District must construct a water treatment facility to remediate Freon contamination in its well located on Diana's Trail in the Village of Roslyn Estates. This well is critical to ensuring that the residents of the District receive an adequate supply of water for all uses. Nassau County has agreed to allow the Roslyn Water District to use a small parcel of land in Christopher Morley Park for the construction of this water treatment facility. The parcel being alienated is situated in a portion of the park that has limited public access and that will not detract from the park's recreational activities nor will it affect the character of the park. In order for this agreement to move forward, the State Legislature must authorize Nassau County to discontinue and alienate the use of this parcel of parkland.
