BILL NUMBER:S7669A

Title of bill

An act to amend the alcoholic beverage control law, in relation to the exemption of certain parcels of land

Purpose or general idea of bill

To allow a restaurant that has an interest in the manufacture of certain liquor and beer to obtain a liquor license.

Summary of specific provisions

Section 1. Amends Section 106 (13) to allow a restaurant/bar and entertainment venue to apply for an on- premises license to serve alcohol.

Justification

The Alcoholic Beverage Control Law prohibits an establishment with an interest, whether direct or indirect, from manufacturing and selling product at retail. The original intent of the law was to encourage competition in the post-prohibition era, however, in many circumstances it now discourages economic development and hinders job and tax revenue growth.

This bill will allow a nationally-recognized entertainment venue to locate in the City of Syracuse within the metes and bounds set forth in the legislation which describe the location of a large retail shopping center. The location of this venue within such shopping center will be on the third level across from three elevators and adjacent to what is known as the "Canyon" area of the shopping center in a space designated L323 as per lease agreements between the venue and the shopping center and as specified on the venue's liquor license.

The venue is expected to hire 150 employees and contribute significant sales tax revenue.
