BILL NUMBER:S7693

Title of bill

An act to amend the workers' compensation law, in relation to the exchange of information between the workers' compensation board and the New York city employees' retirement system

Summary of Provisions: This bill amends paragraph (c) of subdivision 4 of Section 25 of the New York State Workers' Compensation Law (WCL) to require that the Workers' Compensation Board (WCB) provide the New York City Employees' Retirement System (NYCERS) with information relating to WC benefits awarded to retirees whose pension benefit payments are subject to an offset.

Reasons for Support: The NYS Retirement and Social Security Law and the NYC Administrative Code require that certain benefits (mainly accident disability benefits) be offset by the amount of the WC benefit that a retiree receives for the same injury. Implementation of the statutory offset provisions requires access to WC benefit information necessary to finalize a retiree's benefit which is often not readily available at the time of retirement as the WC adjudication process progresses. Rather than depriving retirees of retirement income, statutory and regulatory changes were made whereby retirees could receive benefits pending resolution of their WC cases.

Section 25 of the WCL allows public retirement systems to file claims with the WCB for reimbursement of pension benefit payments advanced or paid to retirees before WC benefits are awarded. However, confirmation of which retirees received WC awards has not been forthcoming which has impacted NYCERS' ability to implement the offset provisions and initiate the claim process in a timely manner. To facilitate the flow of information so that NYCERS may fulfill its statutory obligation in offsetting pension benefits by WC benefits, this bill would establish a simple and efficient process whereby an exchange of information can occur between the two entities on a monthly basis.

Accordingly, the NYCERS Board of Trustees urges the earliest possible favorable consideration of this proposal by the Legislature.

Effective Date of the Bill: This act shall take effect immediately.
