BILL NUMBER:S7778

Title of bill

An act to amend the education law, in relation to licensing to practice acupuncture

Purpose or general idea of bill

To allow acupuncturists who are licensed in another state or country to practice, supervise, provide clinical instruction or conduct clinical research and provide clinical demonstrations in New York state registered licensure qualifying licensure programs and post-graduate programs in acupuncture.

Summary of specific provisions

Section 1 adds a new subdivision to section 8216 of the education law to authorize acupuncturists who are licensed in another state or country to practice, supervise, conduct teaching clinical demonstrations or clinical research in New York State registered acupuncture programs.

Section 2 contains the effective date.

Justification

In 1991 the current acupuncture legislation was enacted which added provisions for NYS registered licensure qualifying licensure programs to become registered in New York state and which modified requirements for faculty length of instruction and faculty exemptions in registered licensure qualifying certification programs for physicians and dentists seeking certification in acupuncture, which also removed the requirement for such programs to work under a research protocol. Nationally accredited acupuncture institutions that operate New York state registered licensure qualifying licensure programs and post-professional programs have also been approved to offer registered licensure qualifying certification programs for physicians and dentists. Faculty in programs leading to registration of physicians and dentists as certified acupuncturists in New York state are exempt from licensure in this State for the purposes of practice, supervision, clinical instruction and clinical research, while faculty in these other registered acupuncture programs are not.

Programs for the training of medical doctors and dentist to become certified acupuncturists have been able to use renowned acupuncture experts from other states and foreign countries for the last 35 years who are exempt from licensure in this State, while registered programs at the graduate degree licensure qualifying licensure and post-professional levels have been precluded from access to such faculty expertise in their programs.

Enactment of this legislation would correct for an inequality in the law for exemption of acupuncture faculty in state registered acupuncture programs, so that all registered programs leading to licensure or certification in acupuncture, and state registered post-professional acupuncture programs would enjoy the same exemption from acupuncture licensure in this state, for the benefit of students in such New York state registered programs.
