BILL NUMBER:S7915
Title of bill
An act to amend the public health law, in relation to uncertified dental assistants
Purpose
Establishes changes to the public health law to require minimum and mandatory educational testing and credentialing standards for an uncertified or unlicensed dental assistant who administers radiologic procedures.
Summary of provisions
Section 1 of the bill amends paragraph (c) of subdivision 4 of section 3515 of the public health law by removing the ability of certified and uncertified dental assistants, under the supervision of a licensed dentist, to operate only such radiographic dental equipment as may be prescribed by the commissioner in rules and regulations for the sole purpose of dental radiography and requires that only licensed dental assistants, under the supervision of a licensed dentist, may operate only such radiographic dental equipment as may be prescribed by the commissioner in rules and regulations for the sole purpose of dental radiography.
Section 2 of the bill establishes the effective date.
Justification
The goal of dental radiography is to obtain useful diagnostic information while keeping patient and operator radiation exposure to a minimum. Dental professionals must have the proper education to expose radiographs to ensure both the operator and patient safety All dental professionals must follow ALARA (As Low As Reasonably Achievable). The acronym means the dental professional utilizing radiation will take every reasonable measure to maintain exposures to ionizing radiation as far below the dose limit as practical. A dental practitioner who has successfully completed schooling for licensure comprehends the necessity to take into account the state of the current technology utilized, the economics of improvements in relation to the state of technology, and the economics of improvements in relation to benefits to the public health and safety. Each of these means are in relation to utilization of radiation in the public interest (ADA, 2012).
