BILL NUMBER:S97

Title of bill

An act to amend the vehicle and traffic law, in relation to directing the commissioner of motor vehicles to provide motorcycle owners with a notice informing such applicant of the laws regarding unidentifiable motor vehicle parts

Purpose

To ensure that motorcyclists are aware of the laws governing unidentifiable motor vehicle parts in New York State.

Summary of provisions

Section 1 provides that upon the issuance of a certificate of registration, the commissioner shall provide a motorcycle owner with a notice regarding the laws governing unidentifiable motorcycle parts, in such form and manner as the commissioner may prescribe.

Justification

There have been instances in New York State where motorcycles have been seized from innocent owners, on the grounds that the vehicle, identification numbers (VINs) of such motorcycles or parts thereof have been destroyed, removed, altered, defaced or covered in a manner so as to be effectually concealed. Often, motorcycle owners are not aware of this law and the process that exists to rectify VIN discrepancies through the Department of Motor Vehicles.
