REGULAR SESSION
SENATOR JOSEPH GRIFFO, Acting President
FRANCIS W. PATIENCE, Secretary
P R O C E E D I N G SACTING PRESIDENT GRIFFO:The Senate will come to order.
I ask all present to please rise and join with me as we recite the Pledge of Allegiance to our Flag.
(Whereupon, the assemblage recited the Pledge of Allegiance to the Flag.)
ACTING PRESIDENT GRIFFO:Today's invocation will be offered by the Reverend Dr. Richard Hasselbach, pastor of the Clarkstown Reformed Church in West Nyack.
Pastor?
PASTOR HASSELBACH:Thank you very much.
And a word of thanks to all of you for your welcome to me today, and especially to Senator Carlucci, who extended this invitation and tremendous warmth.
So let's pray.
Creator God, we praise You for Your presence and Your action in our world. You are the One who gives us the unalienable rights to live in security, to act with freedom, to pursue our happiness, and to be secure in our property. We do not have these rights from any sovereign power other than You. They are the gifts of Your creative love.
Whenever these rights are assailed, You are assailed. Whenever these rights are compromised, Your will is thwarted. And whenever these rights are denied, You weep for Your people.
Bless the members of this body. Give them the courage to do what is right and the wisdom to know what is best for this state and for all of its people.
Let them resist all temptation to do the easy, popular thing rather than the difficult and just thing.
Help them to have servant hearts and to know that the office entrusted to them must be exercised with humility and integrity.
Keep this great deliberative body honest. Let each member transcend the narrowness of party ideology and self-interest. Let them listen in this chamber as well as speak. And as they listen, may it be with open minds and open hearts.
Protect all who work here. Keep them safe in mind and body and free from all harm. Bless the work of the people done here, and protect our Senators from all evil of whatever kind. Make them men and women of integrity, and give them a passion for truth.
We are Your hands and we are Your voice, Creator God, for we are Your people. Inspired by the giants upon whose shoulders we stand, give us the courage to be willing in the struggles of our day to risk all lest we lose what is more than all.
We ask this in Your holy and unutterable name, You the God who creates and sustains us and who has brought us to this moment. You are the One who lives forever. And we can all say amen.
Thank you.
ACTING PRESIDENT GRIFFO:Thank you, Pastor Hasselbach.

ACTING PRESIDENT GRIFFO:Senator Marchione.
SENATOR MARCHIONE:Mr. President, my colleagues, I rise to offer my comments on the legislative resolution before us.
The legislative resolution pays tribute to Rachael Murray, a senior at Tamarac High School. Ms. Murray has the honor of having been selected as the Upstate New York Chapter of the Leukemia and Lymphoma Society's 2013 Girl of the Year.
We often hear so much about courage, inspiration, perseverance. Today we honor someone whose life truly embodies those words; today we honor Rachael Murray.
It was almost one year ago that Ms. Murray was diagnosed with Stage 2A+ Hodgkin's Lymphoma. Despite that, Ms. Murray has always maintained her upbeat, positive attitude, and in so doing showed us all the true meaning of character as she's passing one of life's toughest tests.
Ms. Murray continues to be active, enjoying many activities, including diving, snowboarding, and being with friends. As the 2013 Girl of the Year, Rachael Murray is an inspiration, a positive role model giving hope, providing encouragement, and working toward a cure for blood cancer.
Mr. President and my colleagues, please join me in extending our very warmest Senate welcome to an extraordinary young woman we honor with this legislative resolution today: Rachael Murray.
Welcome.
(Standing ovation.)
SENATOR MARCHIONE:Mr. President, I would just also like to introduce her parents, Bill and Michele Murray, and her brother Ryan.
Welcome to all of you. Thank you for being here.
ACTING PRESIDENT GRIFFO:We welcome all of you and extend the courtesies of the house and extend our special recognition and our admiration for your courage, Rachael. God bless you, and welcome to the Senate.

"RESOLVED, That a copy of this resolution, suitably engrossed, be transmitted to Dylan Conboy."
ACTING PRESIDENT GRIFFO:Senator Breslin.
SENATOR BRESLIN:Thank you, Mr. President.
First of all, may I commend Senator Marchione and the Girl of the Year who was selected, Rachael Murray, and now to the Boy of the Year, who lives in my district.
Two years ago, Jacinda Conboy brought her boy in for a visit to the doctor because he had an ear infection -- she thought he had an ear infection. The doctor was a little rushed in terms of the seriousness and indicated that Ms. Conboy should immediately take her son to the hospital. It alarmed her when she got to the hospital; people were waiting for them. And they were rushed into a room where treatment was begun virtually immediately.
That started the long two years of treatment, worry, concern. And doctors around him, treatments on an ongoing basis.
But the success of the treatments, the attitude of Dylan, who assists the nurses in the treatment, helps out -- and I had the chance to be with Dylan for a little while. Always smiling, as he's smiling over here in the corner right now, and we can hear him, with his brother.
And he set a terrific example. The treatment he's receiving is a three-year treatment. He's through two years. And he's through two years successfully, with that smile. He's been a blessing to his parents, parents who have been very active in this our Albany community.
And, you know, we take things for granted. And sometimes things don't go the way we want. But it's what we do with them when they are before us. And the Conboy family has rallied, and I'm sure they would say probably much closer because of the crisis than before.
But they're on the precipice of victory. And I think the Upstate Chapter of the Leukemia and Lymphoma Society has made a wonderful choice in naming Dylan Conboy as its Boy of the Year.
And Dylan is over there with his brother, Brady, and his parents, Jacinda and Jim. And I think that this chamber applauds not only Rachael Murray, the Girl of the Year, but our own Dylan Conboy.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Thank you, Senator Breslin.
(Standing ovation.)
ACTING PRESIDENT GRIFFO:We welcome to the Conboy family to the chamber, extend the courtesies of the house, and send a special greeting to Dylan, a brave young man. Good luck, and God bless you
Senator Fuschillo.

ACTING PRESIDENT GRIFFO:Senator Young to explain her vote.
SENATOR YOUNG:Thank you, Mr. President. To explain my vote.
I appreciate the support of all my colleagues. And ever since I was elected to state office in 1999, I've devoted a lot of my public service to helping victims. And that's what this bill does. This is a women's issue, and not only that, it protects women and children.
In 1999, Penny Brown of Salamanca was brutally raped and murdered in my district. And as a result, we were able to eventually pass Penny's Law.
The current piece of legislation before us actually makes some significant changes to sexual assault laws in New York State. It's heavily supported by the New York State Association of District Attorneys, the Downstate Coalition for Crime Victims.
And it's based on the terrible case of Lydia Cuomo, who was brutally sexually assaulted in 2011 in Senator Espaillat's district. He's asked me to cosponsor the bill; I gladly have him on board. And I want to thank you, Senator, for that.
Lydia Cuomo has put forward a push to rename several of the sexual assault acts so that they reflect the word "rape" in them. This is what this bill does.
And not only that, it also strengthens the rape laws in New York State. The previous standard has been for vaginal rape to be penetration. This actually loosens the definition to include contact. That would have been very significant in Lydia Cuomo's case, but also it's very significant for all of the rape cases in New York State, because it will make it easier to obtain a conviction.
And prosecutors have told me that this standard especially is helpful in prosecuting child rapists, because the whole notion of penetration is very difficult for children to understand, but they understand touch and they understand contact.
So you are helping so many children and women across the state. There recently was a survey, in 2011; it's estimated that 2 million women have been raped in New York State. Think about that. That is very, very disturbing.
So this bill tackles those very, very serious issues. Again, I want to thank all of my colleagues. I vote yes, and I urge everyone to vote yes also.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Senator Young to be recorded in the affirmative.
Senator Espaillat to explain his vote.
SENATOR ESPAILLAT:Thank you, Mr. President.
I am happy to join Senator Young in this endeavor. And this particular bill does codify a form of rape that is rampant and pervasive and has not been codified in this form before in the State of New York.
And it is supported by many of our district attorneys, including New York County District Attorney Cy Vance and others.
This is an excellent bill. The victim, who likes not to be defined by this act -- and, you know, in a recent interview, Lydia Cuomo said that she will not allow this incident to define her life. Well, more so, the efforts on her part to change the future is really what she would like to have define her life.
And she was here several months ago, and we were happy to have her here. She's very courageous. She came forward. The perpetrator was an off-duty police officer. This was a heinous crime that happened just right across from my house.
And so I am happy to join Senator Young in making sure that this bill becomes law.
Thank you, Mr. President.
ACTING PRESIDENT GRIFFO:Senator Espaillat to be recorded in the affirmative.
Senator Ruth Hassell-Thompson to explain her vote.
SENATOR HASSELL-THOMPSON:Thank you, Mr. President. I rise to lend my support to this bill as well.
In the past, other versions of this bill have come forward, and I was very hesitant. And I know that people have asked why, as the person who has chaired the Task Force on Domestic Violence and has brought bills to this floor around rape and assault.
But I think that one of the things that law must be is clear. And so that I think that in working on this bill more, you have brought clarity and a fuller explanation than perhaps we had before. And I thank you for your diligence in staying with it and bringing a bill to the floor that all of us can support.
ACTING PRESIDENT GRIFFO:Senator Ruth Hassell-Thompson to be recorded in the affirmative.
Senator Nozzolio to explain his vote.
SENATOR NOZZOLIO:Thank you, Mr. President.
Mr. President, I rise in support of this legislation and urge my colleagues to support this effort.
Senator Young should be congratulated for taking the lead on ensuring that the victims of this heinous crime will be punished appropriately.
This measure clearly ensures that those who commit violence are going to be dealt with in a very serious manner, that the sentencing structure of this state will ensure the maximum penalties are provided to those who commit such heinous activity.
The District Attorneys Association, as well as a number of crime victims' rights groups, including the Downstate Coalition for Crime Victims, firmly this legislation, strongly encourage the Legislation to enact this measure, and in their advocacy to protect victims of violence, ensure that those who perpetrate this type of violence will be sent to prison and will be kept in prison for a very long period of time.
Any efforts to dilute the consecutive sentencing approach that the district attorneys need to have as a utilization in prosecuting these cases, any dilution of that ability to prosecute, to ensure consecutive sentencing, will be a very sad but clear signal to crime victims that they will not get the protection of our laws.
On the other hand, Senator Young's bill does just the opposite: ensure that the protection of victims, the consideration of victims, the respect for our crime victims will be ensured and stabilized by the legislation that we are going to enact today.
Mr. President and my colleagues, I support the measure.
ACTING PRESIDENT GRIFFO:Senator Nozzolio to be recorded in the affirmative.
