BILL NUMBER:S1107

Title of bill

An act to amend the real property tax law, in relation to service of petition in a challenge to a real property assessment upon a fire district

Purpose

To provide actual notice to the Board of Fire Commissioner of a pending challenge to a real property assessment within the fire district.

Summary of provisions

Amends subdivision 3 of Section 708 of the Real Property Tax Law to include the Board of Fire Commissioners among the municipal governmental entities which receive actual notice of challenges to real property assessments.

Justification

This legislation would provide for actual notice to the Board of Fire Commissioners of challengers to the assessments of real property located within the fire district. Fire Districts are municipal corporations whose budgets are in part controlled by the taxable valuation of the real property located within the fire district. Periodically, the assessment of said real property is challenged by the owner of said property by the filing of a petition for tax certiorari action. Presently, notice of said action is received only by the assessor's office of the town or city in which the property is located and the superintendent of schools.
