BILL NUMBER:S1159B

Title of bill

An act to grant Cole Samsel eligibility for permanent appointment as a police officer with the police department of the village of Oxford, in the county of Chenango

Purpose of bill

Grants eligibility to Cole Samsel for permanent appointment as a police officer with the village of Oxford police department

Summary of specific provisions

Section 1. Notwithstanding any provision of paragraph (a) of subdivision 1 or subdivision 4 of section 58 of the civil service law to the contra- ry, Cole Samsel, who previously received a permanent appointment in the competitive class of civil service as a police officer with the sher- iff's department of the county of Chenango, resigned from such position after several years, has been absent from such position for more than 30 days and is over the age of 35, shall be eligible to take the compet- itive civil service examination for the position of police officer and shall, contingent upon his score on such examination, be eligible to be placed on the eligible list for appointment as a full-time patrolman for the village of Oxford.

Section 2. Cole Samsel shall otherwise be subject to the merit and fitness provisions of the civil service law applicable to full-time police officers

Section 3. Effective Date

Justification

Under the Civil Service Law, as proscribed under Section 58, no individ- ual may take the Civil Service examination nor be eligible for a Civil Service eligibility limit of the age of 35 or older. Due to this limita- tion, the Village of Oxford Police Department has requested legislation to permit one of their part-time officers, Cole Samsel, to be eligible to take the Civil Service examination since he is currently 35 years old. In small rural areas, it is difficult to attract or maintain quali- fied applicants to fill such positions. The resurgence of heroin and increase in criminal activity is on the rise, filling this full-time officer position would enable the police department to reduce crime and better protect the community. Upon Cole Samsel passing the examination, should qualify him to fill the vacant full-time position within the Village of Oxford Police Department
