BILL NUMBER:S1393

Title of bill

An act to amend the executive law, in relation to designating the Bronx river as an inland waterway for purposes of waterfront revitalization

Purpose

Designates the Bronx River as an inland waterway

Summary of provisions

Section 1 amends paragraph (b) of subdivision 4 of section 911 of the executive law, as separately amended by chapters 265, 272, 298, 310 and 311 of the laws of 2014, by adding the Bronx River to the definition of "inland waterways."

Section 2 contains the effective date.

Justification

The Bronx River plays a vital role in Westchester County and is within the Long Island Sound watershed. Classifying it as an inland waterway would help to provide federal funds to restore and protect the river, at no cost to the State.

The Bronx River Advisory Board (BRAB) is an intermunicipal task force established by the Westchester County Board of Legislators and the towns and villages in the Bronx River Basin. The Advisory board has issued a request to add the Bronx River to the definition of inland waterways, which would permit the municipalities in the Bronx River basin to apply for grants under the Local Waterfront Revitalization Program.

The County Legislature recently adopted the BRAB's Stormwater Reconnaissance Plan for the Bronx River Watershed, which identifies numerous projects in each municipality that address myriad issues relating to stormwater management, flood mitigation and daylighting. The plan identifies the need for the State to cooperate with local municipalities on a watershed-wide basis in order to be able to significantly reduce flooding. This bill achieves that goal.

By including the Bronx River in the definition of inland waterways, these projects will be eligible to compete for funding, which will create jobs, reduce flooding and protect the environment.
