BILL NUMBER:S1414
Title of bill
An act relating to waiving certain income requirements for a commercial food fishing license
Purpose
Authorizes the Commissioner of the Department of Environmental Conservation to waive income eligibility requirements for certain persons if the Commissioner is satisfied that all other requirements for a commercial food fishing license is met.
Summary of provisions
Section 1 of this bill authorizes the Commissioner of the DEC to waive the income eligibility requirements pursuant to section 13-0328 of the environmental conservation law if the Commissioner is satisfied that all other requirements for a commercial food fishing license are met pursuant to section 13-0335 of the environmental conservation law and issue such license to Naval First Class Petty Officer Kevin Lynch.
Section 2 of this bill provides that this act shall be effective immediately.
Justification
Mr. Lynch is a retired First Class Petty Officer from the United States Navy. Petty Officer Lynch has honorably served our country for twenty years in the United States Navy and has extensive experience working on boats, ships and the commercial fishing industry. Upon retiring from the Navy, Kevin had planned to go into continue his career as a commercial fisherman but New York State Environmental Conservation law would now allow him to obtain a license. Section 13-0328 of the Environmental Conservation Law contains a requirement that an applicant for a commercial food fishing license earn at least $20,000 per year for three consecutive years within the fishing industry in order to be issued a license. Given Petty Officer Lynch's admirable twenty year career in the United States Navy he has been unable to meet this requirement.
Last year the Senate passed legislation that would aid our veterans in finding jobs once they return from service, and New York State has in place a law that is standing between a veteran and his chosen post-service profession. The Senate should pass this legislation and ensure that the State does not unintentionally stand in the way of veterans finding employment.
