BILL NUMBER:S1421
Title of bill
An act to amend the public health law, in relation to requiring tattoo studios and body piercing studios to use single use needles and inks, to obtain consent forms from customers and to maintain customer consent forms for a period of not less than seven years
Purpose
To amend the public health law, in order to ensure the safe use of needles and inks during piercing and tattooing, as well as obtaining and maintaining consent forms.
Summary of provisions
Section 1 of this bill defines single use ink and single use needle.
Section 2 relates to the explicit use of sealed and sterile single use needles and inks in all tattoo and body piercing procedures performed in an establishment. Consent forms must also be signed by the person receiving tattoo or piercing and tattooist or body piercing specialist affirming that all materials used are sterile and were opened in front of such person receiving service.
Section 3 relates to effective date.
Justification
There are currently no rules or regulations requiring a tattooist or body piercing specialist to be held accountable for the materials used during the process of a tattoo or piercing. Diseases are easily spread through reused needles and ink. This piece of legislation requires single use needles and inks are used and disposed of properly afterward to prevent the spread of disease through reusable materials.
The bill requires a tattooist or body piercing specialists to present the materials that will be used to the individual receiving the tattoo or piercing in a sealed and sterile state and open the material in front of such person. A consent form is required to be signed and returned by stating the compliance with this act and retained by the tattoo or body piercing studio for a period of 7 years.
