BILL NUMBER:S1688

Title of bill

An act to amend the education law, in relation to the practice of neurofeedback therapy

Purpose

To define, license and limit the practice of neurofeedback therapy; and to establish a state board of neurofeedback therapy.

Summary of provisions

Section 1 defines the practice of neurofeedback therapy; establishes requirements for licensure; issuance of limited permits; imposes practice restrictions and certain exemptions; and creates the state board of neurofeedback therapy. Section 2 provides the effective date.

Justification

The practice of neurofeedback is the use of sensitive instruments to measure the electrophysiology of the brain and convert the measurements into information that can be understood for the purpose of regulating brain activity. It is used in conjunction with mental counseling and physical therapy; to improve performance in the arts, music and sports; and to improve functioning in the aged. It is used most significantly by those addicted to drugs and/or alcohol. Currently, there is no assurance that practitioners are trained in the proper techniques, ethics and procedures of neurofeedback therapy. In order to protect the public from the incorrect use and misrepresentation of neurofeedback therapy, licensing is essential.
