BILL NUMBER:S1765

Title of bill

An act to repeal sections, 1, 1-a, 1-b, 1-c, 1-d, 2, 3, 3-a, 3-b, 3-c, 3-d, 4, 4-a, 4-b, 4-c, 5, 7, 8, 9 and 10 of chapter 43 of the laws of 2014 amending the vehicle and traffic law and other laws relating to establishing in the counties of Nassau and Suffolk a demonstration program implementing speed violation monitoring systems in school speed zones by means of photo devices

Purpose

To repeal the authorization of Nassau and Suffolk counties to implement the use of speed cameras in school zones.

Summary of provisions

Section one repeals the relevant sections.

Section two sets the effective date.

Justification

Chapter 43 of 2014 authorized the use of speed enforcement cameras in school zones. The bill was introduced only after the receipt of unanimously passed home rule messages from the legislatures of Nassau and Suffolk counties. Since that time, however, the Nassau County legislature unanimously repealed its previous authorization and use of such cameras and Suffolk County has indicated that it does not have plans to implement its program. This bill would reflect the decisions of those counties and remove the authorization for them to implement such program in the future.
