BILL NUMBER:S2100

Title of bill

An act to amend the labor law, in relation to prohibiting the awarding of state and municipal contracts to contractors who have been debarred in another state

Purpose

To prohibit contractors who are debarred in other states from competing for state and municipal contracts in New York.

Summary of provisions

This bill adds a new section 7-a to Section 861-e of the Labor Law. It provides that contractors who are debarred in any state for conduct which would constitute debarment in New York, shall be ineligible to submit a bid on or be awarded any public contract with the state or any municipal corporation, public benefit corporation or public body within the state for a period of five years from the date such person or entity was debarred from such state.

Justification

New York has a very thorough system for insuring that public bidding and contract awards adhere to strict standards to insure fairness and transparency. The system also provides that debarred New York companies cannot participate. This bill would extend that debarment to bidders who have been debarred in another state for conduct which would constitute debarment in New York.
