BILL NUMBER:S2300
Title of bill
An act to amend the public health law, the education law, the general business law and the vehicle and traffic law, in relation to making conforming changes reflecting the previously authorized scope of practice of nurse practitioners
Purpose or general idea of bill
To conform various sections of law with the 2014 legislation in relation to nurse practitioner (NP) written collaboration or practice agreements. It would not affect any scope of practice.
Summary of specific provisions
Sections 1 through 5 and 8 through 10 remove many references to NPs performing various functions in accordance with a written practice agreement and replaces them with references to the NP acting in his or her lawful scope of practice, which would mean in accordance with a written practice agreement where that is applicable and in accordance with a collaborative relationship where that is applicable.
Section 1 amends PHL § 3602(4) and (5), relating to an NP prescribing or ordering home care services.
Section 2 amends PHL § 579 (1), relating to NPs providing clinical laboratory test solely as an adjunct to the treatment of a patient.
Section 3 amends Education Law § 902 (2)(a), relating to NPs performing school health services.
Section 4 amends Education Law § 903(1), relating to NPs providing primary and secondary school health certificates.
Section 5 amends General Business Law § 406 (1)(e), relating to NPs providing cosmetology health certificates.
Sections 6 and 7 amend General Business Law §§ 433(3) and 434 to permit NPs to provide and certify physical exams for barber license applicants.
Sections 8 and 9 amend Vehicle and Traffic Law § 404-a(4) and (5)(b), relation to NPs providing certificates of disability.
Section 10 amends Vehicle and Traffic Law § 509-g(1), relating to NPs providing bus driver health certificates.
Section 11 clarifies that the preceding sections shall not be construed to expand or contract the NP scope of practice.
Section 12 provides an effective date.
Justification
The Nurse Practice Act in the Education Law was amended in 2014 to eliminate the requirement of a written practice agreement for NPs with over 3600 hours of practice experience. The amendments in this bill are necessary to eliminate now-inappropriate references to agreements that are no longer required. The Nurse Practice Act provides the necessary requirements for NPs whose practice experience is less than 3600 hours (who work under a written collaboration or practice agreement) and others (who work under a collaborative relationship).
