BILL NUMBER:S2653A
Title of bill
An act to amend the highway law, in relation to authorizing the town of Deerfield in Oneida county to transfer jurisdiction of a road to the state
Purpose
To allow the Town of Deerfield to transfer responsibility of the road known as the south-bound access road to New York State.
Summary of provisions
Section 1. Amends subdivision 31 of section 341 of the highway law to authorize and direct the commissioner to assume jurisdiction for state highway purposes over the road identified as the south-bound service road and associated ramp sections built under New York state department of transportation contract D250071.
Section 2. Authorizes the commissioner of transportation and the town of Deerfield to permanently close such portions of the highway transferred to the state as necessary.
Section 3. Transfers all right, title and interest of the town of Deerfield in the transferred highways to the state.
Section 4. Sets the effective date.
Justification
This bill would alleviate the burden of maintenance for the town of Deerfield of the road known as the south-bound service road. The road runs adjacent to existing roads maintained by the state, and serves as an access road to land owned by the State University of New York.
This road is a significant inconvenience for the town of Deerfield both financially and logistically. Therefore it would seem reasonable for the state to assume responsibility for the south-bound access road, especially due to the fact that the state maintains the roadways and ramps that run parallel and adjacent to the road in question.
