BILL NUMBER:S2927
Title of bill
An act to amend chapter 330 of the laws of 2011 amending the town law relating to payments for certain school, fire, fire protection, and ambulance districts for lands exempt from real property taxation for purposes which implement the Peconic Bay community preservation fund, and permitting the town of Southampton to make such payments in certain cases, in relation to providing annual payments to the East Quogue union free school district
Purpose
Relates to providing annual payments to the East Quogue Union Free School District from the Peconic Bay Community Preservation Fund by the Town of Southampton
Summary of provisions
Amends Section 2 of Chapter 330 of the Laws of 2011, amending the Town Law, to permit the Town of Southampton to make annual payments from its Community Preservation Fund to the East Quogue Union Free School District.
Justification
Under current law, the Town of Southampton is permitted to make annual payments from its Community Preservation Fund to certain high-tax school, fire, fire protection, and ambulance districts which have been taken off the tax rolls. As such, the Riverhead Central School District, Hampton Bays Union Free School District, and the Eastport-South Manor Central School District are eligible to receive Payments in Lieu of Taxes (PILOT) for protected lands within such school districts to help mitigate the impact of the lost tax revenues. In order for the Town of Southampton to continue its efforts in preserving the landscapes and resources that are so vital to maintaining the unique character of Long Island's east end, this legislation is necessary to permit the Town to make annual payments from the Peconic Bay Community Preservation Fund to the East Quogue Union Free School District.
