BILL NUMBER:S3086

Title of bill

An act to amend the public service law, in relation to the purchase and procurement of natural gas at lowest available price at the city gate

Purpose

The purpose of this bill is to ensure that gas corporations purchase gas at the lowest available price from instate or out-of-state sources.

Summary of provisions

Section 1: Amends section 66-f of the Public Service Law.

Justification

Gas utilities are required to purchase natural gas at the lowest available price. This price should be the price at city gate and should not be arbitrarily determined by subjectively taking into account "substantive differences" in the terms and conditions applicable to the sale of such gas. Natural gas producers should have the opportunity to provide gas at the lowest price if they demonstrate an ability to do so. Gas utilities should be required to show whether or not an offer by a natural gas producer to provide gas at the lowest available price at city gate benefits ratepayers; especially in comparison to out-of-state purchases where the additional costs of gas pipeline transportation are involved.
