BILL NUMBER:S3108
Title of bill
An act to authorize the village of Garden City, in the county of Nassau, to offer an optional twenty year retirement plan to police officer Anthony Baker
Purpose
To authorize the Village of Garden City, which previously elected to offer the optional 20 year retirement plan to police officers employed by the Village, to make participation in such plan available to Anthony Baker, a police officer employed by the Village.
Summary of provisions
Section one authorizes the Village of Garden City to offer the optional 20 year retirement plan, established pursuant to section 384-d of the retirement and social security law, to police officer Anthony Maker, who for reasons not ascribable to his own negligence failed to make a timely application to participate in such optional 20 year retirement plan. The Village may so elect by filing with the Comptroller by December 31, 2016, a resolution of the Village Board of Trustees together with a certification that such police officer did not bar himself from participation in such plan as a result of his own negligence.
Section two requires that all past service costs associated with implementing this provision be borne by the Village of Garden City.
Section three provides that the act shall take effect immediately.
Justification
Police Officer Anthony Baker was hired by the Village of Garden City on May 24, 2011, and was registered under the wrong retirement plan. According to the Village, due to a clerical error and miscommunication with the retirement system, P.O. Baker was enrolled in the New York State Police and Fire Retirement Plan 375i. The Village of Garden City has requested this legislation authorizing them to offer an optional 20 year retirement plan to P.O. Baker. All costs associated with implementing this provision will be borne by the Village.
