Title of bill

An act to amend the environmental conservation law, in relation to application fees for tidal wetlands permits

Purpose

Decreases application fees for tidal wetlands permits.

Summary of provisions

Subdivision 8 of section 70-0117 of the environmental conservation law, as added by section 1 of part AAA of chapter 59 of the laws of 2009, is amended.

Justification

The goal of this legislation is to make the fee structure for tidal wetland and freshwater wetland permits the same, thereby eliminating the current fee disparity. In the 2009-10 Budget, a provision was included relating to fees for tidal and freshwater wetland permit applications. Although both applications require the filing of the same forms, there is a huge disparity in the fees. Freshwater wetland fees range form $50-$200 while the fees for tidal wetland permit applications range from $200-$900. The discrepancy is alarming and should be adjusted to reflect the same fee structure.
