BILL NUMBER:S3282

Title of bill

An act to amend the public health law, in relation to an emergency program to provide cannabidiol access to patients with epilepsy or other serious conditions

Purpose

This bill will require the Commissioner of Health to establish an emergency cannabidiol access program to allow persons with epilepsy or other serious conditions to access medical marijuana containing a high amount of CBD and a low amount of tetrahydrocannabinol (THC) before the establishment of the State's medical marijuana program.

Summary of provisions

Section 1 contains the legislative intent.

Section 2 requires the Commissioner of Health to establish an emergency cannabidiol access programs for persons with epilepsy or other serious conditions prior to the establishment of the State's medical marijuana program.

Section 3 contains the effective date.

Justification

Thousands of patients across New York State suffer from life threatening health issues that cause them unbearable pain and suffering every day. Debilitating illnesses and diseases make every day a struggle. Meanwhile, immediate access to treatment with medical marijuana will not be available until the State's medical marijuana program becomes operational on or after January 2016. Unfortunately for many patients, that is simply too long to wait.

New York State has a responsibility to help patients now, while the medical marijuana program is under construction. This legislation is necessary to require the Commissioner of Health to establish an emergency cannabidiol access program, so suffering patients will not be forced to endure a prolonged wait for the state's medical marijuana program to be finalized.

Legislative history

New Bill.

Fiscal implications

None.

Effective date

This act shall take effect immediately and shall expire and be deemed repealed upon the Commissioner of Health's certification that the medical marijuana products being made available on an emergency basis through this program are available through the medical marijuana program established by Chapter 90 of the laws of 2014, or its successor.
