BILL NUMBER:S3422
Title of bill
An act to amend the real property law, in relation to conveyances of paper streets in the town of Westfield, county of Chautauqua
Purpose
Requires the conveyance of a paper street in the town of Westfield, county of Chautauqua, to be accompanied by a resolution of the town board of such town.
Summary of provisions
Section 1 Subdivision 2 of Section 291-a of the real property law is amended to add Westfield to the list of municipalities that require a resolution from the town board or village board for a deed or instrument of conveyance relating to property including a paper street.
Justification
Paper streets are roads or streets that appeared on municipal maps when originally filed, but were never subsequently developed into a roadway. Because street maps are often based on official municipal land records, they may show these paper streets as actually existing.
As a result, paper streets can be incorrectly understood to be part of private adjoining properties when in reality they remain owned by a municipality.
While installing new water lines under paper streets, the town became aware that many adjoining property owners were under the false impression they owned the paper streets
By adding the Town of Westfield to the list of those municipalities in Chautauqua County requiring a resolution from the town for a deed or instrument of conveyance for a paper street, their status will be clarified for property owners and those filing deeds
