Title of bill
An act to authorize the commissioner of general services to transfer and convey certain unappropriated state land to the village of Freeport
Purpose
To transfer and convey to the Village of Freeport the state land known as the Freeport Armory.
Summary of provisions
Section 1 of this bill provides that the commissioner of general services is hereby authorized to transfer and convey to the village of Freeport, in consideration of one dollar and upon such other consideration as the commissioner may deem proper, the state land located at 63 Babylon Turnpike, Freeport, known as the Freeport Armory, declared to be abandoned state land by the Division of Military and Naval Affairs.
Section 2 of this bill provides that all piece or parcel of land, situate, lying and being in the Village of Freeport, in the County of Nassau, State of New York, be described as containing about three acres. These lands are the same as described in a deed from the Village of Freeport to the People of the state of New York, dated June 13, 1949 and recorded in the Nassau County Clerk's Office on June 20, 1949, in Book 3857 of Deeds at page 384.
Section 3 of this bill provides that the land to be conveyed as described in section 2 of this act, is not intended to be a legal description but is intended to identify the parcel to be conveyed.
Section 4 of this bill provides that the Office of General Services (OGS) shall not transfer or convey the aforesaid land unless an application is made to OGS in a form that is acceptable to OGS by the Village of Freeport, and said application must be made within one year after the effective date of this act.
Section 5 of this bill provides a reverter clause whereby if the Village of Freeport ceases to utilize the subject property, known as the Freeport Armory and which is defined previously in the bill, for general municipal purposes, then the land would revert to the State of New York.
Section 6 of this bill provides that this act shall take effect immediately.
Justification
The Freeport Armory is a centrally-located, convenient meeting place for many veterans and veterans organizations in the Village of Freeport. However, while the Freeport Armory is an enormous benefit to veterans, this facility would also greatly benefit other local organizations and public efforts including, but not limited to, the storage of public works equipment; civic organization and municipal government meetings and projects; youth and senior events and clubs; and other general municipal purposes, to the benefit of the Village of Freeport as a whole. This legislation would ensure the most responsible, flexible, and effective stewardship of the Freeport Armory property.
